What are my rights as a tenant when it comes to mold exposure?
About a year ago, give or take, there was a leak in my bathroom wall coming from upstairs. The water had gotten caught between the sheet rock and the paint. It went all the way from the ceiling to the floor and was about 3 inches wide. I never reported it to management because it dried up and I didn't think it would be a problem...stupid, I know. Fast forward to about 2 months ago and the same thing happened again only this time there was a small pocket of water left. Again, I never reported it thinking it wouldn't be a problem. Well, my daughter and I have been getting sick lately back to back...coughing, sneezing, colds, sinus infections, ear infections, eye infections, bronchitis. I thought it was because she goes to daycare and is getting sick from the other kids and bringing home the germs to me. My apartment is a small studio and it is just my daughter and I so I leave my bathroom door open all the time and we sleep right next to it. Today I closed it for a couple of hours and when I went to open it was hit with the funk of mildew. I hadn't smelled it before and I'm uming that's because the door is always open so it probably airs out into the rest of the apartment. I feel horrible now because I feel it's my fault why my daughter has been having all these problems. I called my management company and they are coming first thing in the morning to look at it. I don't know what exactly they are going to do but unless they are going to rip out the whole wall and repair it, I don't want to live here anymore. I want to know what my rights are as a tenant when it comes to mold exposure. I can doent how many times we've been to the doctor and the ER in the last few months. Can I break my lease?
